# Watch for the public sector and associations: anticipating rules, funds and procurement with citable sources

**In short**

For a public administration or an association, watching is the systematic tracking of the regulatory, technological and social changes that affect its policies, services or members, with the source of each data point in view. Its value lies in arriving in time for the stages where it can still have an influence: the prior public consultation of a State rule lasts at least fifteen calendar days, and the hearing and public information stage fifteen working days.

## At what point in a rule should you find out about it?

A rule does not appear on the day it is published. Each stage is a different signal and opens or closes an opportunity to take part. For State rules, Law 50/1997 on the Government sets out the route[\[1\]](https://www.innguma.com/en/sectors/public-sector/#ref-1); in the EU, the ordinary legislative procedure adds its own stages:

| Stage | Where it is published | Deadline or key data | What it allows |
| --- | --- | --- | --- |
| Prior public consultation (State rules) | Website of the competent ministry | Minimum of fifteen calendar days (Article 26.2 of Law 50/1997) | Commenting on the problem and the alternatives before a text exists |
| Hearing and public information | Website of the competent ministry | Minimum of fifteen working days, reducible to seven for urgency (Article 26.6) | Submitting allegations on a specific draft |
| European legislative proposal | European Commission and the European Parliament’s Legislative Observatory | Date of the proposal and the responsible parliamentary committee | Preparing a position for the negotiation between Parliament and the Council |
| Publication | BOE or the Official Journal of the EU | Date of entry into force | Planning the adaptation |
| Application | Text of the rule and application guidance | Dates in phases: in the AI Regulation, transparency from 2 August 2026 and high-risk systems in Annex III from 2 December 2027[\[2\]](https://www.innguma.com/en/sectors/public-sector/#ref-2) | Complying, and informing members or citizens |

## What framework has changed for administrations?

- **Cybersecurity.** The NIS2 Directive had to be transposed before 17 October 2024 and covers public administrations[\[3\]](https://www.innguma.com/en/sectors/public-sector/#ref-3). Spain was among the 19 Member States that received a reasoned opinion on 7 May 2025 for not having notified full transposition[\[4\]](https://www.innguma.com/en/sectors/public-sector/#ref-4); the status of the Spanish law should be followed in the BOE. The National Security Framework (ENS), regulated by Royal Decree 311/2022, applies to the whole public sector and to the providers that serve it, and requires a certification audit for systems in the MEDIUM or HIGH category[\[5\]](https://www.innguma.com/en/sectors/public-sector/#ref-5).
- **Artificial intelligence.** The AI Regulation applies for the most part from 2 August 2026, with dates for high-risk systems amended by the digital omnibus. Many of them are in public service areas, such as access to benefits or employment[\[2\]](https://www.innguma.com/en/sectors/public-sector/#ref-2).
- **Interoperability.** The Interoperable Europe Act (Regulation (EU) 2024/903) has applied since 12 July 2024, and from January 2025 requires interoperability assessments for certain digital public services[\[6\]](https://www.innguma.com/en/sectors/public-sector/#ref-6).
- **Public procurement.** Law 9/2017 on Public Sector Contracts, which transposes Directives 2014/23/EU and 2014/24/EU, regulates the contracting profile, preliminary market consultations and the Plataforma de Contratación del Sector Público[\[7\]](https://www.innguma.com/en/sectors/public-sector/#ref-7). Above the European thresholds, notices are also published in TED, the supplement to the Official Journal of the EU, which carries around 800,000 notices a year[\[8\]](https://www.innguma.com/en/sectors/public-sector/#ref-8).

## What does an administration watch, and what does an association watch?

They share sources but not questions:

- **An administration** watches to design policies and services: the rules it will have to apply, European programmes and funds, technologies that affect its infrastructure, good practice from other administrations, and what the market offers before it tenders, which is what preliminary consultations are for.
- **An association or cluster** watches to represent and inform its members: rules under consultation that affect them, calls they can apply for, tenders in their sector and market moves. Its product is the newsletter and its positioning, and both need citable sources.

## How to set up watching in a public organisation

1. Start from the agenda: regulatory plans, strategies in preparation, contracts that will be renewed.
2. Assign each topic to a responsible unit that validates it.
3. Define the sources by stage: participation portals, official gazettes, procurement platforms, European bodies.
4. Decide where each signal goes: an internal report, a newsletter to members, an allegation, or a briefing for a tender specification.
5. Keep what has been validated with its source, to justify decisions and so that the knowledge survives changes of team and of legislature.

## Common mistakes

- Finding out about a rule at the hearing stage, when a text already exists, rather than at the prior consultation.
- Following only the State procurement platform and not the regional platforms or TED.
- Sending members a summary without a link to the original source.
- Losing institutional memory when staff rotate.

## How Innguma works with administrations and associations

Innguma monitors news and websites, regulation and the BOE, tenders, patents, competitors’ websites and specialist sources. In Factory, the space where Innguma processes and structures signals, the AI groups duplicates and classifies each signal by category, technology, entity, type of event, place and tone, and each signal links to its source. People decide what is watched, what is published and who receives it; what is validated is kept in the Library, and newsletters are prepared from there. Innguma holds the ENS certification at MEDIUM level (certificate 34/5704/24/05039, issued by OCA Global and valid until June 2028) for the systems that support its managed watch services, and the UNE 166006:2018 certification of its watch and intelligence system (certificate 34/5705/25/01139, OCA Global, valid until January 2028). The service can be run with your own team or with Innguma Service.

Use case

## How the day-to-day changes

**Today, in many teams**

- Public consultations are discovered when the deadline is about to close.
- The newsletter for members is prepared by hand, copying news items without a source.
- What was known about a rule is lost when the person responsible for it changes.

**A day with Innguma**

1. When reviewing the inbox

A ministry's prior public consultation arrives classified by topic and affected sector, alongside what was published earlier on that subject.

2. Weekly

A newsletter for members with rules in progress, and calls and tenders in the sector, each signal with its original source.

3. Before submitting comments

In the Library, the history of the rule: versions, earlier positions and comments from the technical team.

**Arriving in time**

Consultations and hearings are seen while it is still possible to take part.

**Citable information**

Each data point reaches members with its source.

**Institutional memory**

The history stays even when people change.

**How Innguma does it**

- Monitoring of regulation and Spain's Official State Gazette (BOE), tenders, news and websites of public bodies and specialist sources.
- AI classification by category, entity, type of event, place and tone, with the source always linked.
- Library with tags and comments, and newsletters with summaries prepared by AI sent from it.

**What does not change**

Positioning and public decisions belong to your organisation. Innguma gathers, organises and keeps; the judgement is yours.

**Where to start**

1. A watch on *public consultations and draft regulations affecting your members*
2. A watch on *sector tenders on state and regional platforms and TED*
3. A watch on *AI and cybersecurity obligations for your services*
